MSNBC legal analyst says First Amendment makes US ‘vulnerable,’ calls for ‘common sense’ speech restrictions

When asked by host Rachel Maddow whether America is just as susceptible to disinformation as other countries, McQuade argued that it is even more vulnerable.

“Actually, Rachel, I think we’re more susceptible to it than other countries, and that’s because some of our greatest strengths can also be our Achilles Heel,” McQuade said. “So, for example, our deep commitment to free speech in our First Amendment. It is a cherished right. It’s an important right in democracy, and nobody wants to get rid of it, but it makes us vulnerable to claims [that] anything we want to do related to speech is censorship.”

She argued, “Of course, the Supreme Court has held that all fundamental rights, even the right to free speech, can be limited as long as there is a compelling governmental interest and the restriction is narrowly tailored to achieve that interest. But I think any time someone tries to do anything that might limit free speech, people claim censorship.”

McQuade held up as an example this week’s Supreme Court cases regarding state laws about how social media platforms moderate content.


“We need to have a conversation and common-sense solutions to these things,” she said. “Instead, we throw out terms like ‘censorship,’ call each other names, use labels and retreat to our opposite sides. We need to be pragmatic and come up with real solutions.”

“But, it is, I think, one of the things that makes America particularly vulnerable to disinformation,” she concluded.

Maddow praised the book’s arguments and touted McQuade’s work as a “real public service and a pleasure.”




In other news, a Supreme Court Justice says the 1st amendment "Hamstrings" the Government and Government censorship is needed! A damned Supreme Court Justice!

We have laws for defamation, libel, and slander. I think though that they are aiming for propaganda, particularly any that opposes their own propaganda that will be the real truthful information. In their own words they want to, "do anything that might limit free speech", what "people claim" to be "censorship". Obviously that won't include limiting their speech, just anyone else's speech that disagrees with them.

Ketanji Brown has no damned business on the Supreme Court if that's the way she thinks. The Supreme Court is tasked with deciding issues of Constitutionality. In order to do that, one must have some idea of how the Constitution functions. The Bill of Rights, for example, does not confer any rights at all on the government. it's entire reason for existing is to put restrictions on the government, to restrict it from trying to interfere with YOUR rights.

So, the government cannot lean on a private business in order to force it to do things the government is not allowed to do. Now that business can decide on it's own to restrict free speech, because the First Amendment restricts government, not private entities. BUT the government cannot lean on a private entity to get it to do things the government cannot, because in doing so, they make that entity a government agent, as it is acting on government's behalf, as a proxy. When that happens, the private entity is suddenly bound by the same restrictions that the government is, because it is acting in the government's stead.It effectively becomes an arm of government by virtue of acting on government's orders.

These are not opinions, they are facts dictated by logic and reasoning.

Mr. Beck was slightly incorrect in hi definition of "inalienable" "inalienable" simply means that your rights cannot be alienated from you - they cannot be separated from your being. It has nothing to do with "changing" or "altering" rights, it just means that your rights are a part of you, cannot be separated from you. Changing or altering rights necessarily involves separating them from the individual, so it all really boils down to separating or "alienating" your rights from you person. The same use of "alienate" is found in the legal phrase "alienation of affections" - separating one from the affections of another. It's all just a matter of separation.

Explanation: A Right is the ability and the capacity to do something as enabled by existing in this universe with this set of universal laws aka a God Given Right, so the right to self defense is based on being born with tooth and claw as mother nature determined we should all possess and the right to be armed is enshrined in the ability to literally pick up any rock and or stick and or gun etc and use it to defend yourself and your rights etc. For example I have the right to KILL you, for any and or no reasons whatsoever,  and be captured and arrested by the government forces of justice and go to court and plead how I want or even not and be possibly found guilty and sentenced to death etc. and that right is counterbalanced by your right to get revenge via the state punishing me as a criminal murderer ok. Everything is CHECKS AND BALANCES ok, so I have the ability to say whatever I want to because simply I can and possibly will and that is checked and counterbalanced by your right to kill me if you dont like my fighting words ok.

These rights are GOD GIVEN and nobody can take them away from you at all ever. They can however be diminished by you not protecting them, understanding them and using them as freely and as often as you can and as you please ok.

The constitution does NOT grant you these rights at all, just like reading the bible doesnt grant and guarantee your automatic spiritual survival, and is merely a document that inhibits the GOVERNMENTS rights and abilities to power over your rights ok. 

The government can NOT for example cancel your rights to be a wrong headed loud mouthed online pornography addicted asshole just because it is convenient or for whatever reasons it can think up on the spot etc as a matter of law. Yes shouting fire in a theater is your 1st amendment right but it is checked and balance by others peoples right to NOT be misled into a dangerous situation where they might get trampled by panicking people who are afraid that they might immediately die by fire in a enclosed space etc. If you dont know your rights then you certainly most probably dont understand what other peoples rights are either and  you might not even know or understand the governments rights and abilities, which is all powerful as they are a socially collective authority and since you are not a socially collective authority, when push comes to shove violently 'they' [aka all others] will always win in the end and in the long run, hence why we all as a collective and as individuals even need a constitution the PREVENTS them [aka the nation] from actually legally doing that without great moral cause to do so. So yeah I can slander and defame you under the 1st amendment right and you have the rights for the government justice system to get revenge upon me for having done so etc. 

If you work for the government in ANY capacity then you are acting as the government and as a literal extension of the entity and you are therefor under the constitution and both legally and morally prevented from infringing upons anothers rights, so if the government asks you or your private business to curtail online posts and or speech or text and you agree to do that then that is ILLEGAL under the constitution. IF you want to do it as a unsolicited private person and or private company then that is your right to do so, we can civilly sue you for that as a check and counterbalance point, but as Ninurta said above you can NOT act as a PROXY for government political and or economic wishes.

The government has the right to watch on dispassionately as it cant do legally anything about that. Even when it comes to national security and defense reasonings and it must just sit there and suck its thumb and scratch its own bum quietly, because if the government acts as a propaganda mill that determines what is acceptable mindthink then it has become a tyranny of control over your mindset and such a thing is an anathema to freedom loving individuals everywhere ok.

Kinetic warfare is just poltical warfare by other means [aka the battle for the social collectives mindsets] and political warfare is just economic warfare by other means and it as always boils down to the MONEY, which is just a game we all play. If God had wanted us to use money he would of given it to us himself, but he is against usury and greed and so I personally think that God doesnt have a hardon for money at all and it is said that both money and the love of money are the ROOT of all evil ok, and rule 1 of conspiracy theory is FOLLOW the money and see where that leads you and what that uncovers. 

God just wants you to repent it all and turn back to him, and the satanic system just wants you to shut the fuck up and do what you are told without any hesitations and or questions like a goosestepping robot and I would rather die fighting on my own two thinking feet whilst yelling, screaming and questioning than live silently sucking satans scaly dick and swallowing his septic shock semen on my knees ok.

Explanation: The main problem with 'common sense' is that it is 100IQ or less, stupid in nature. And why would I settle for that eh? I want an UNCOMMON sense that will guide me through all the bullshyte.

Possessing an Uncommon sense is a RARE gift of genius that only smart people will really appreciate ok, because it has unique insights into dealing with anything and everything. Don't follow the herd and be and become prey to mob mentallity, as that panders to the lowest common denominator and is a shyte reality. 

Personal Disclosure: I will be 'reasonable' when they can actually see and identify real reasons based upon rationality and logic!

Until then, they have fucked around and now they can and will find out the limits of their own stupidity, which has led them up the garden path and over a cliff of credible uncertainty in how to deal with undesirable mindsets and dangerous attitudes safely eh?!

There is no such thing as safe and or safely as there is always a risk that must be taken and odds are youre going to lose in the long run and or the end. It is a kill or be killed, eat or be eaten, law of the jungle reality and the only way to actually deal with that is to not rely on somebody elses morality. Combat rules are for the stupid ok. You are not irreplacable so don't get too high and mighty in your own self worth and learn to value something greater than yourself, which is the TRUTH, which unfortunately most people can not handle as it is explosive in nature in the hands of the stupid dumb cunts that ruin it all for everyone by being woke karens/kevins ok.
